WHAT IS AN “UNCONTESTED” DIVORCE?

In New York, the phrase “uncontested divorce” refers to a divorce proceeding in which (a) there are no disagreements between you and your spouse over any financial or divorce-related issues (i.e., the division of marital property, maintenance, or issues relating to children); and (b) your spouse either agrees to the divorce or does not oppose your divorce action. In uncontested divorce cases, you are no required to appear in front of a judge. Instead, a divorce is granted “on the papers”, based on uncontested divorce forms that you submit to the Court Clerk’s office. Uncontested divorces proceed much more quickly, and are less costly, than divorce cases that are contested or fully litigated.
