Uncontested No-Fault Divorce Kit With Children


There are two ways to obtain a no-fault divorce in Louisiana: (1) a divorce filed under Louisiana Civil Code Art. 102 (A ‘102 Divorce’); and (2) a divorce filed under Louisiana Civil Code Art. 103 (A ‘103 Divorce’). Filing for a 102 Divorce allows you to file for divorce immediately, and prior to the parties living separate and apart continuously for a specified amount of time. If you have minor children born of this marriage, the parties must live separate and apart continuously for a period of 365 days before any type of divorce can be granted. On the other hand, 103 divorce can only be filed if the parties have already lived separate and apart for the required 365 days. (**NOTE: If you file a 102 divorce, the community terminates retroactive to the date of filing the initial petition.) This package is for use in cases in which a no-fault divorce is sought pursuant to Louisiana Civil Code Art. 102.
