SUMMARY OF IDAHO DIVORCE LAWS AND PROCEDURE
The following is
a brief summary of the divorce laws and procedures in Idaho.

- Idaho Divorce Residency Requirements:
The party filing for an Idaho divorce must be a State resident for at least six weeks immediately prior to filing for divorce.
Idaho Divorce Filing Requirements:

An Idaho divorce action should be commenced in either the county where the non-filing party resides or, if the non-filing party is not a State resident, the county where the filing party resides.
Idaho Divorce Grounds:

The grounds for Idaho divorce are as follows:
- irreconcilable differences;
- living separate and apart without cohabitation for a period of 5 years;
- adultery;
- permanent insanity;
- conviction of a felony;
- willful desertion;
- cruelty;
- willful neglect; and
- habitual drunkenness.
